The Jasper County Circuit Court in Missouri has preliminarily approved a class action settlement in the matter of Colson et al v. Protein Solutions, LLC, case no. Case No. 19AO-CC00071.
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $975, 000, less costs and attorneys’ fees, for: (a) all persons who submitted a data sheet to Class Counsel prior to April 15, 2020, indicating that they experienced odors from the Facility; and (b) all renters and owners who are (or were at any point in time from March 15, 2014, to the present) occupants of residential property that reside within two (2)miles of the Facility’s property boundary. The lawsuit, filed in 2019, alleged that noxious odors from the industrial protein processing created a nuisance for neighboring residents. The company denies any responsibility for alleged nuisance. The City of Joplin has not received any odor complaints from residents since 2019.
