Nestle Purina Petcare Co. Settlement

The U.S. District Court for the Eastern District of Pennsylvania has preliminarily approved a class action settlement in the matter of Fuehrer v. Nestle Purina Petcare Co., Case No. 5:20-cv-03910.

The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $800,000, less costs and attorneys’ fees, for all owners or occupiers of residential property located within a 1.75-mile radius of the Defendant’s Facility located at 2050 Pope Road, Allentown, Pennsylvania at any point in time from August 11, 2018, to the present (the “Class Period”). The lawsuit alleged that noxious odors from the facility created a nuisance for neighboring residents. The company denies any responsibility for any alleged nuisance.

There are several Court-ordered deadlines that must be followed by members of the class:

  • Claim Forms must be postmarked on or before June 1, 2021, in order to receive compensation from the Settlement Fund.
  • Opt-Outs and Objections must be postmarked on or before June 1, 2021.
