The U.S. District Court for the Southern District of Florida has preliminarily approved a class action settlement in the matter of Miranda v. Waste Management of Florida, Inc., Case No. 20-cv-23257-civ-AMC. The lawsuit alleged that noxious odors from the landfill created a nuisance for neighboring residents. The company denies any responsibility for any alleged nuisance.
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $1,112,500, less court-approved costs and attorneys’ fees, to be paid by Defendant Waste Management of Florida, which operates the Medley Landfill located at 9350 NW 89th Avenue, Medley, Florida 33178.
The $1,112,500 cash fund is provided by Defendant for the benefit of all owner/occupants, tenants, renters or lessees of each residential property located within the following Class Area (outlined in red) who submit a valid, timely claim form:
The Settlement also requires Defendant to invest $500,000 in improvement measures at the Landfill, which are designed to reduce odor emissions at the Landfill. If the Settlement Agreement is approved by the Court, these valuable improvement measures will be implemented within 12 months of the Effective Date of the Settlement.
All owner/occupants, tenants, renters or lessees of residential property located within the Class Area at any point in time between March 19, 2016 and the present are eligible to fill out and submit a claim form, which are attached below, in order to receive payment from the Settlement Fund.
