Residents in Mobile, Alabama have enlisted attorneys from Liddle & Dubin to file a class action lawsuit against GAF Materials Corporation on their behalf alleging that odors from the company’s facility have interfered with their ability to use and enjoy their property.
GAF’s roofing shingle and asphalt material manufacturing facility, located at 2400 Emogene Street, is located in the midtown area of Mobile surrounded by a residential community.
Numerous complaints have been filed with the Alabama Department of Environmental Management ("ADEM") by residents of the adjacent neighborhood community due to noxious odors attributed to Defendant's facility. Many of these odors were specifically described as "roofing tar" odors. In October of 2015, the ADEM performed a week-long odor survey on Defendant's facility, which confirmed the presence of off-site odors attributed to Defendant's facility.
Since the filing of the class-action lawsuit, GAF announced that it will be closing its Mobile facility in 2019. According to the company, the decision was not related to the pending lawsuit. While the company has plans to suspend its operations at the facility in the future, the lawsuit seeks compensation for the odors residents have been forced to endure for the past several years before the lawsuit was filed. Therefore, the shuttering of the facility will have no bearing on the substance of the case going forward.
