Cleveland-area residents have filed a class action lawsuit against Collinwood Bio-Energy alleging that the facility blankets the adjacent neighborhood with odors that negatively impact their ability to use and enjoy their homes.
The facility, located at 13550 Aspinwall Ave, in the City of Cleveland, produces renewable energy through digesting organic matter and producing biogas which is then converted into electricity. This process has, according to residents, created odors that prompted the filing of the lawsuit on their behalf by lawyers from Liddle & Dubin, P.C.
The investigation into the company has shown that it has a well-documented history of failing to control its emissions. The company has received Notices of Violations (NOVs) from the Ohio Environmental Protection Agency ("OEPA") for the release of odors constituting an Air Pollution Nuisance and the Cleveland Division of Air Quality for the release of odor emissions into the atmosphere after complaints from neighboring residents.
