After years of trying tirelessly to work with their city to curb odors emanating from a neighboring plastic manufacturing facility, frustrated residents have asked Liddle & Dubin, P.C. to file a class-action lawsuit on their behalf.
At its 500,000-square-foot factory facility, API Industries, Inc, doing business as Aluf Plastics, manufactures industrial liners and other plastic products 24 hours per day 6 days per week. Since the 1980's, the facility has grown from utilizing 8 extruders to 70. Through the extrusion process, Aluf melts tons of solid plastic daily into a liquid that it then re-manufactures into new plastic products such as plastic bags.
Residents argue that the company has not adequately updated the facility’s pollution control as it has increased production. This process has, according to some residents, caused significant odors to blanket the area and prompted numerous complaints to the New York Department of Environmental Conservation (NYDEC). As a result, since May of 2016, the NYDEC has issued three (3) Notices of Violation against Aluf for odors emitted from its facility and faulty ductwork within its carbon filtration system.
