Western Sugar Cooperative Settlement

A Judge for the 13th Judicial District Court in Morgan County Colorado has preliminarily approved a class action settlement in the matter of Alley et al v. Western Sugar Cooperative, case no. 2017CV30078.

The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $950,000, less costs and attorneys’ fees, for all persons who do not affirmatively and timely opt out of the Settlement and who are owner/occupants and renters of residential property residing in the “Class Area” (whose households are depicted in the map below) at any point in time on or after October 4, 2015.

The lawsuit, filed in 2018, alleged that noxious odors from the sugar beet processing facility created a nuisance for neighboring residents. The company denies any responsibility for the alleged nuisance and notes that several, significant improvements have been made at the facility. As a result. the company has received very few odor related complaints since these changes were fully implemented.

There are several Court-ordered deadlines that must be followed by members of the class:

  • Claim Forms must be postmarked on or before June 27, 2020, in order to receive compensation from the Settlement Fund.
  • Opt Outs and Objections must be postmarked on or before June 12, 2020.
