The U.S. District Court for the Western District of Wisconsin has preliminarily approved a class action settlement in the matter of Hamilton et al v. 3D IdaPro Solutions, LLC, case no. 3:18-cv-00054-jdp.
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $725, 000, less costs and attorneys’ fees, for (a) all persons who submitted a data sheet to Class Counsel prior to October 31, 2019; and (b) all renters and owners who owned or occupied residential property at any time since January 24, 2012 within one and a half (1.5) miles of the Facility’s property boundary, located at 2721 Industrial Street, Wisconsin Rapids, WI 54495.
The lawsuit, filed in 2018, alleged that noxious odors from the potato dehydration facility created a nuisance for neighboring residents. The company denies any responsibility for alleged nuisance and noted that many improvements were made since it purchased the facility from the previous owners in 2016.
The Company worked with two firms experienced with odor control technology, installed and updated a scrubber, changed certain operational procedures at the plant, and worked with government officials to develop a “best practices management plan” completed in November 2017. The company has not received any odor related citations from the City of Wisconsin Rapids since these changes were fully implemented in November 2017.
