The U.S. District Court for District of Oregon has preliminarily approved a class action settlement in the matter of Genta et al. v. 3D IdaPro Solutions, LLC, case no. 2:19-cv-00286-MO.
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $500,000, less costs and attorneys’ fees, for all owners or occupiers of residential property located within a four-mile radius of the Defendant’s Facility located at 405 Hoosier Road, Stanfield, Oregon at any point in time from February 26, 2013, to the present (the “Class Period”), and all owners or occupiers of residential property who submitted a residential data sheet to Class Counsel concerning odors or emissions from the Facility on or before April 15, 2020.
The lawsuit, filed in 2019, alleged that noxious odors from the facility created a nuisance for neighboring residents. The company denies any responsibility for any alleged nuisance and noted that it has since ceased all operations at the Stanfield facility.
