Amerities West Odor Emissions Class Action Lawsuit

Liddle & Dubin, P.C., together with Oregon attorney Nick Kahl, have filed a class action lawsuit against AmeriTies West, LLC, the operator of a railroad tie plant in The Dalles, Oregon. The lawsuit alleges that the Defendant’s plant emits noxious odors which have interfered with its neighbors’ ability to fully use and enjoy their homes. Michigan Sugar Company Odor Investigation

Lowell Energy Biodigester Odor Investigation

Liddle & Dubin, P.C. is currently investigating the emission of odors from the Lowell Energy AD biodigester in Lowell, Michigan.

Foul odors have been plaguing the area surrounding the biodigester, and neighbors have compared the smell to “road kill.”

The Lowell police have issued the plant more than a dozen citations this year, and the plant’s owners appear to have acknowledged that they have caused this problem, despite promising before the plant opened that it would not emit foul odors.

ArcelorMittal Monessen Coke Facility Class Action Settlement

A class action settlement is pending with ArcelorMittal Monessen LLC, a wholly owned subsidiary of ArcelorMittal USA, Inc. ("Defendant") in the United States District Court for the Western District of Pennsylvania.

The lawsuit was brought by Viktoryia Maroz and Edward Tolliver ("Plaintiffs") against the Defendant seeking property damages (not personal injuries).  Plaintiffs asserted various legal claims against the Defendant, based on the allegation that the noxious odors and air particulates ("emissions") were emitted by Defendant's facility, located at 345 Donner Avenue, Monessen, Pennsylvania 15062, and impacted nearby properties.

Arbor Hills Landfill Odor Class Action

On April 25, 2016, Liddle & Dubin PC filed a class action lawsuit against Advanced Disposal Services Arbor Hills Landfill, Inc after numerous residents contacted the law firm with complaints about excessive odors inundating their community.  The Complaint alleges that noxious odors emitted from the landfill, located at located at 10690 Six Mile Rd, Northville, MI 48168, interfere with neighboring residents’ ability to use or enjoy their property. 

The case seeks compensation for the nuisance created by the odors and for any negative impact the odors have had on property values.  The odor lawsuit also seeks to change the way the Defendant operates the landfill in order to significantly reduce, if not eliminate, the emission of odors into the surrounding community.
